Adjective Noun (the "Company") is committed to protecting your Personal Data (defined below). This Privacy Policy applies to your use of the website, hostburro.com (the "Site"), and the related hosting on hburro.com or custom domain, administrative, and add-on APIs (collectively, the "API") (together, the "Services"). The Privacy Policy explains how we collect, use, and share personal data. The HostBurro Terms and the definitions therein (hostburro.com/terms) are incorporated herein. By using the Services, you ("you" or "your") consent to the terms described in this Privacy Policy. Our Services are only available to US residents. If you are not a US resident, please do not use our Services and we will not be responsible for any such use.

Age Restriction

Our Services are available for use by individuals over the age of 18, or who have obtained consent from their parent and/or legal guardian. Our Services are not targeted to, intended to be consumed by, or designed to entice individuals under the age of 18. If you know of or have reason to believe anyone under the age of 18 has provided us with any Personal Data, please contact us.

Personal Data We Collect

Personal Data can mean any information that identifies or can be used to identify an individual directly or indirectly. Personal Data may be provided by you and include, without limitation, your name, address, backup email addresses, telephone number, and/or location; contact preferences; account login information; or billing details. If you are an individual user who is assigned an account on our Services, your account may be managed by an administrator of your company or employer, or other authorized third-party (for example, a family member or guardian) (the "Administrator"). The Administrator is both responsible for 1) your access and use if they provide you with access to and use of an account and 2) the Personal Data residing in your account and any accounts they administer. In this case, alternative and/or additional terms may apply as determined by the Administrator's privacy and other related policies. The Administrator will also be able to access or disable your account. Both you and the Administrator are responsible for complying with the Terms of Service.

Personal Data may also be collected by us automatically when delivering our Services to you. These may include, without limitation:

  • Cookies and similar technologies ("Cookies") on our Site that allow us to store your preferences and settings, enable you to sign in, fight fraud and improve our Services. Cookies are automatically used to collect data when you use and interact with our Services, including metadata, log files, cookie/device IDs, page load time, server response time, and approximate location information to measure website performance and improve our systems, including optimizing DNS resolution, network routing and server configurations. More specifically, interactions with the features, content and links (including those of third-parties, such as social media plugins) contained within the Services, Internet Protocol (IP) address, browser type and settings, the date and time the Services were used, information about browser configuration and plugins, language preferences and cookie data, information about devices accessing the Services, including type of device, what operating system is used, device settings, application IDs, unique device identifiers and error data are collected. We may also use certain Cookies to make advertising messages more relevant to you and your interests. These Cookies may also perform functions like preventing the same ad from continuously reappearing, ensuring that ads are properly displayed, and displaying ads tailored to your interests.
  • We and our third party partners may use "web beacons" to help deliver Cookies and gather usage and performance data. "Web beacons" help us determine whether email correspondence with the Company was delivered and opened and whether links within the email were clicked.
  • When you visit our Site, or purchase our Services, we use Facebook Pixel and Google Analytics which may set cookies to inform us of the effectiveness of paid advertisements we place on other sites on the internet. We share data with these third parties as described in the section "Sharing of Personal Data" below.

You are able to control the data collected by Cookies, web beacons, and similar technologies by using controls in your browser to limit how the websites you visit are able to use Cookies. Through these controls, you can withdraw your consent by clearing or blocking Cookies.

Use of Personal Data

We use Personal Data to provide support and updates, improve and develop our Services, personalize our Services, advertise and market to you, troubleshoot, operate our business, comply with legal obligations, analyze data to help improve the way we run our business, and optimize our performance.

Integrations with Other Products

We may use the Personal Data we collect or receive through the Service, as a processor and as otherwise stated in this Privacy Policy, to enable your use of the integrations and plugins you choose to connect to your HostBurro account. For instance, if you choose to connect a Dropbox integration to your HostBurro account, we will ask you to grant us permission to view and/or download, as applicable, your files, Paper documents, etc. This allows us to configure your Dropbox integration(s) in accordance with your preferences. For example, if you wanted to use the Dropbox integration to share a file using your HostBurro account, we would need to access this file stored in Dropbox and share it on your behalf.

Your Control of Personal Data

You can control your Personal Data, and exercise your data protection rights, by contacting the Company (contact information is provided at the end of the Privacy Policy) including, without limitation, controlling the use of Personal Data for interest-based advertising from the Company by opting out, and/or choosing whether to receive promotional communications from us (e.g., emails, telephone calls, and text messages). However, in certain instances, your ability to access or control your Personal Data may be limited by applicable law.

Personal Data of End Users

If you use HostBurro with an account provided by an Administrator , that Administrator can:

  • Control and administer your HostBurro account, including controlling privacy-related settings of the account.
  • Access and process your Personal Data, including the interaction data, diagnostic data, and the contents of your communications and files associated with your HostBurro accounts.

If you lose access to your account (such as when you change your employment), you may lose access to the content associated with the Service.

If the Administrator provides you with access to HostBurro Services, your use of HostBurro is subject to the Administrator's policies in addition to ours. The Administrator will be responsible for responding to your privacy questions. The Company is not responsible for the privacy or data security policies of the Administrator.

When you use our Services as provided by an Administrator, the Company's processing of your Personal Data in connection with our Service is governed by an agreement between the Company and the Administrator. If you have questions about how we process your Personal Data, please contact the Administrator.

Sharing of Personal Data

Adjective Noun may share and/or disclose your Personal Data:

  • with Google Analytics , to A) monitor Site usage, to B) know if you used our Services after seeing an ad shown through Google, and to C) allow Google ad retargeting for prospective customers. Google Analytics may use cookies and other similar tracking technologies, such as pixels and web beacons, to gather information about your activities. While using our Services, the only data accessible to our advertising partners is that which may be gathered by loading one of their web trackers in your browser. No further Personal Data disclosed to the Company is shared with our advertising partners without express consent from you or the Administrator.
  • with Facebook Pixel to know if you have used our Services after seeing our ad on Facebook and to allow Facebook ad retargeting for prospective customers. Facebook may use cookies, web beacons, and other storage technologies to collect or receive information from the Site and elsewhere on the internet and use that information to provide measurement services and target ads. The only data accessible by our advertising partners is that which may be gathered by loading one of their web trackers in your browser. No further Personal Data disclosed to the Company is shared with our advertising partners without express consent from you or the Administrator.
  • with competent law enforcement bodies, regulatory bodies, government agencies, or court to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies, to exercise, establish, or defend our legal rights, or to protect your interests or those of any other person.
  • in the event of a sale, merger, consolidation, liquidation, reorganization, or acquisition. Should such an event occur, such an acquirer will be subject to our obligations under this Privacy Policy. We will notify you of the change by sending you an email if you have the notification preference enabled and posting a notice on our Site.
  • with our third party payment processor, Stripe, to process payments made to us. In connection with the processing of such payments, we seek to maintain minimal financial information, including avoiding the storing of credit card numbers, in our systems. Rather, information is relayed to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy, though we maintain a record of your email address and other information required by Stripe.
  • with our cloud infrastructure partners, Amazon Web Services, Digital Ocean, and Google Cloud Platform. The Services are provided using the infrastructure of these partners. Personal Data may be stored and processed on the services/infrastructure of one or more of these service partners. Personal Data is encrypted in transit and at rest on all underlying infrastructure.

This list of service provider partners, and the intent under which we use them, is exhaustive. The precise data fields used/stored/shared is not exhaustive. At any time, the list of third-party partners may change, and a new version of the Privacy Policy will be posted with an updated list.

Third-Party Websites

The Site may include links to third party websites, whose privacy practices may be different from ours. If you submit Personal Data to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

Data Retention/Security

Data Retention

When a HostBurro account is closed, data will be held for a minimum of one month (this helps with issues of accidental account deletion, etc.) before eventual permanent deletion. Active accounts will have data retained indefinitely. Billing data and any data related to the business relationship between the company and the account holding Administrator will be retained indefinitely for accounting and other business purposes. Deleted files are permanently deleted from production servers on a best-effort basis. Deleted data may be retained in encrypted backups indefinitely.

Adjective Noun reserves the right to periodically review and change this policy from time to time and we will notify users with notification preference enabled about changes to our Privacy Policy. Continued use of the Service will be deemed as acceptance of such changes.

Data Security

We store most of your Personal Data electronically. We implement and maintain appropriate technical and organizational security measures, policies and procedures designed to reduce the risk of accidental destruction or loss, misuse or interference or the unauthorized disclosure, access or modification to such information appropriate to the nature of the information concerned. The security of your Personal Data is paramount and a critical consideration for the Company in the provision of its services to you.  All network services are at risk of security breaches, and the Services provided by the Company are no exception. We go to great lengths to secure your Personal Data, including but not limited to: encrypting it in transit and at rest, logging data access, by default limiting access privileges for Company staff and automated services, auditing access logs, and frequently reviewing security best practices. In the unlikely event of Personal Data being exfiltrated from the Services without the express permission and authority of the Company (a "Data Breach"), administrators of all potentially affected accounts will be notified within 72 hours of the Company becoming aware.

Amendment to the Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy and any other places we deem appropriate. If we make material changes to this Privacy Policy, we will notify you here, by email, or by means of a notice on our home page, at least thirty (30) days prior to the implementation of the changes. Your subsequent use of the Site and/or Services after such a notice constitutes your consent to such amendments. If you do not consent to such amendments, please do not use the Site, API, and/or Services.
